MusicBeacon Terms and Conditions
Please read these terms carefully before using our app.
Welcome to MusicBeacon's Terms and Conditions of Use (these "Terms"). This is a contract between you and Appventiq (Pty) Ltd ("MusicBeacon", "we", "us", or "our") and we want you to know yours and our rights before you use the MusicBeacon mobile application ("MusicBeacon" or the "App"). Please take a few moments to read these Terms before enjoying the App, because once you access, view or use the App, you are going to be legally bound by these Terms.
Please also read our Community Guidelines (which form part of these Terms) and our Privacy Policy.
Please be aware that if you subscribe to premium services for a term (the "Initial Term"), then the terms of your subscription will be automatically renewed for additional periods of the same duration as the Initial Term at MusicBeacon's then-current fee for such services, unless you cancel your subscription in accordance with Section 6 below.
1MusicBeacon Rules
Before you can use the App, you will need to register for an account ("Account"). In order to create an Account you must:
- be at least 13 years old;
- be legally permitted to use the App by the laws of your home country;
- connect your Spotify account to share and discover music.
Please note that we monitor for underage use and we will terminate, suspend or ask you to verify your Account if we have reason to believe that you may be underage.
You can create an Account via manual registration, using your Apple ID, or by using your Spotify login details. If you create an Account using third-party login details, you authorize us to access, display and use certain information from your account (e.g. profile pictures, music preferences, location information). For more information about what information we use and how we use it, please check out our Privacy Policy.
Unfortunately, we cannot allow you to use another person's MusicBeacon account or to share your MusicBeacon account with any other person without permission. You are responsible for ensuring that any use of your account complies with these Terms.
2Types of Content
There are three types of content that you will be able to access on the App:
- content that you upload and provide ("Your Content");
- content that members provide ("Member Content"); and
- content that MusicBeacon provides ("Our Content").
Music and Content Guidelines
We want our users to be able to express themselves through music, but we have to impose restrictions on certain content which:
- is illegal or encourages, promotes or incites any illegal activity;
- is harmful to minors;
- is defamatory or libelous;
- infringes any third party's rights (including intellectual property rights);
- contains language or imagery which could be deemed offensive;
- is abusive, insulting or threatening, discriminatory or which promotes hatred;
- relates to commercial activities without permission;
- involves spam or unsolicited communications;
- impersonates or intends to deceive others;
- contains malicious code or viruses.
3Music Sharing and Discovery
MusicBeacon allows you to share your currently playing music with other users nearby and discover what others are listening to. By using this feature:
- You consent to sharing your music listening activity with nearby users;
- You understand that your location is used to show you nearby music;
- You can control your privacy settings to limit what information is shared;
- You must respect others' music preferences and not engage in harassment.
4Chat and Communication
MusicBeacon provides chat functionality to connect with other music lovers. When using chat features:
- Be respectful and kind to other users;
- Do not share personal contact information;
- Do not use chat for commercial purposes;
- Report any inappropriate behavior immediately;
- We may monitor chats to ensure safety and compliance.
5Premium Services
MusicBeacon offers premium features including:
- Extended discovery radius (up to 10km);
- Unlimited nearby users;
- Music listening history;
- Ad-free experience;
- Premium badge on profile.
Premium subscriptions automatically renew unless cancelled. You can cancel anytime through your account settings or the app store where you purchased the subscription.
6Payment Terms
If you choose to purchase premium services, you acknowledge that:
- Payments are processed through Apple App Store, Google Play Store, or RevenueCat;
- Subscriptions automatically renew unless cancelled;
- Refunds are handled according to the platform's policies;
- Prices may vary by region and are subject to change;
- Free trials may convert to paid subscriptions.
7Privacy and Data
For information about how MusicBeacon collects, uses, and shares your personal data, please check out our Privacy Policy. By using MusicBeacon, you acknowledge that we may use such data in accordance with our Privacy Policy.
We use your location data to show you nearby music and users. You can control location sharing in your device settings, but this may limit app functionality.
8User Conduct
You agree to:
- Use your real name and accurate information;
- Respect other users and their music preferences;
- Comply with all applicable laws;
- Use the app for personal, non-commercial purposes;
- Report inappropriate behavior or content.
You agree that you will not:
- Harass, stalk, or threaten other users;
- Create fake accounts or impersonate others;
- Use the app for spam or commercial activities;
- Attempt to hack or disrupt the service;
- Share inappropriate or offensive content.
9Account Termination
We reserve the right to terminate or suspend your account if you violate these Terms or engage in inappropriate conduct. You can delete your account at any time through the app settings.
10Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THE COMPATIBILITY OF MUSIC MATCHES OR THE ACCURACY OF USER-PROVIDED INFORMATION.
11Limitation of Liability
MUSICBEACON SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
12Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of South Africa.
13Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes through the app or by email. Your continued use of the app after changes constitutes acceptance of the new Terms.
